Ehefähigkeit
Da die Eheschliessung in der Form eines Vertrages erfolgt, sind zur Eingehung einer Ehe nur diejenigen fähig, denen im allgemeinen die Handlungsfähigkeit zusteht; damit sind alle diejenigen ausgeschlossen, denen die physische oder psychische Fähigkeit mangelt, ihren Willen zu äussern, also vor allem die Taubstummen, Unzurechnungsfähigen und Minderjährigen (Cheresch schote wekatan).
Den Taubstummen wurde freilich durch eine Anordnung der Mischna (Jew. 14, 1) die Ehe ermöglicht, vorausgesetzt, dass sie sich durch Zeichensprache verständlich machen können. Die Ehe von völlig Unzurechnungsfähigen war auch nach talmudischem Recht ungültig (b. Jew. 112b); jedoch wurde denen, die nur gemindert oder zeitweise unzurechnungsfähig waren, die Möglichkeit zur Eheschliessung gegeben. – Ein Minderjähriger kann eine Ehe selbst nicht eingehen; hingegen kann der Vater für seine minderjährige Tochter ohne deren Wissen, ja auch gegen deren Willen eine Ehe schliessen. Diese Eheschliessung der minderjährigen Tochter mag in biblischer Zeit, da die Frühehe vorherrschend war, vielfach zur Anwendung gekommen sein, in talmudischer Zeit wird sie jedoch bereits abgelehnt (b. Kidd. 4la; E. H. 37, 8). Ist die Minderjährige jedoch von ihrer Mutter oder von ihren Brüdern verheiratet worden, so kann sie später, nachdem sie mündig und handlungsfähig geworden ist, die Anerkennung dieser Ehe verweigern (s. Me-un).
Zeugungsunfähigkeit ist ein absolutes Ehehindernis; die Eunuchen und Kastraten können daher nicht heiraten (Deut. 23, 2), der Tumtum (Verstopfte, bei dem die Genitalien so tief liegen, dass sein Geschlecht nicht erkennbar ist) erst nach genauer Feststellung seines Geschlechts.
