11. Warum dürfen muslimische Männer durchaus eine Nicht-Muslimin heiraten, Muslimas jedoch keine nicht-muslimischen Männer?
Mein Versuch einer Antwort:
Ich muss als erstes die Frage konkretisieren, denn ein muslimischer Mann darf nicht einfach irgendeine Nichtmuslimin heiraten. Es gibt folgende Bedingungen, damit diese Ehe Gültigkeit erlangt und somit erlaubt ist.
1. Die Nichtmuslimin muss entweder eine Christin oder eine Jüdin sein.
Die Heirat von Nichtmusliminnen anderer Konfessionen ist dem muslimischen Mann verboten.
2. Die Frau von den Leuten der Schrift muss keusch sein.
Also nicht die Form von Frauen, die wir zumeist hier in Deutschland antreffen, die sich z.B. betrinken, sexy anziehen, in die Disco gehen, wechselnde Geschlechtspartner haben/hatten usw.
3. Der Wali (Vormund) der Frau muss seine Zustimmung für diese Heirat geben und es müssen die rechtlichen Bedingungen einer islamischen Eheschließung eingehalten werden.
Der Wali ist normalerweise der Vater. Sollte dieser bereits verstorben sein, unzurechnungsfähig oder nicht auffindbar, dann ist es der volljährige Bruder oder ein eingesetzter Wali. Die Bedingungen einer islamischen Eheschliessung sind vielfältig. U.a. gehört dazu die Mahr (Brautgabe), der Ehevertrag und die 2 Zeugen bzw die öffentliche Bekanntmachung.
„Der juedische Glauben besteht in erster Linie darin , dass die Tora(-Bibel) ein g-ttliches Buch ist , welches durch seinen Boten(-Moses) an die Menschheit gegeben wurde . In diesem Buch offenbart uns G-tt , was wir tun duerfen , und was nicht . Da diese Gebote g-ttlichen Ursprungs sind , ist es toericht , nach dem Sinn zu Fragen . Wir haben diese Gesetze zu erfuellen , weil G-tt es so will , und das ist der einzige Grund ! Und eines dieser Gesetze ist z.B. das erwaehnte Verbot fuer Schweinefleisch , … . Allerdings steht es uns frei , zu versuchen , den Willen G-ttes zu verstehen . Aber , wie auch immer wir dies erklaeren wollen , hat dies keinen Einfluss auf die volle immerwaehrende verpflichtende Gesetzeskraft aller Gebote .“

Ich finde er hat das sehr schön ausgedrückt. Sicherlich gibt es immer auch Leute, die versuchen die Gesetze und Regeln unserer Religionen zu deuten und zu ergründen, aber egal was dem beschränkten kleinen Gehirn eines Menschen auch dabei entfleucht – wie z.B. die „der-fehlende-Kühlschrank-im frühen-Orient-These“ bezügl. dem Schweinefleischverbot -, es hat keinen Einfluss auf die Gesetzgebung.
Sicherlich gibt es, besonders heutzutage, Menschen die diese Regeln und Gesetze als ungerecht und gar verabscheuungswürdig empfinden. Diese Personen können sich diesen Gesetzen entziehen, indem sie diese Religionen nicht annehmen oder verlassen. Aber der Trend zeigt, dass immer mehr Menschen die Weisheit hinter den Gesetzen erkennen und auch in der Botschaft, die noch über diesen Gesetzen steht, nämlich, …
„dass es nur einen Schöpfer, Lenker, Herrscher, Richter und Allgerechten gibt, der es verdient hat angebetet zu werden und dem zu gehorchen ein Geschenk ist und keine Bürde, und das allein Seine Gesandten und Propheten die Berechtigung hatten Seine Regeln und Gesetze zu empfangen und zu verbreiten. Unter ihnen der Letzte, dass Siegel aller Propheten und Gesandten, Muhammad -Allah segne ihn und schenke ihm Heil-„.
Zum Schluss möchte ich noch anmerken, dass auch im Judentum sogenannte Mischehen verboten sind. Hier gilt es in der Regel für Männer und Frauen aus anderen Völkern und Religionsgemeinschaften. Im Wörterbuch des Jüdischen Rechts findet sich allerdings ein kleiner Einschub der belegt, dass es in Ausnahmen wohl erlaubt war, unter bestimmten Bedingungen, nichtjüdische Frauen zu heiraten:
Andererseits aber werden mehrfach auch Mischehen erwähnt, die keinen Anstoß erregten: Josef heiratet die Tochter eines ägypt. Priesters (Gen. 41, 45), Moses die Tochter des midjanitischen Priesters Jetro (Ex. 2, 21). Auch aus den Vorschriften über die Behandlung der Kriegsgefangenen (Deut. 21, 11) scheint hervorzugehen, daß die Ehe mit fremden Frauen gestattet war, jedoch hatte dem Abschluß der Ehe ein Wechsel des Religionsbekenntnisses vorauszugehen, wie dies auch aus Rut 1, 16 („dein Gott sei mein Gott“) entnommen werden kann (Maimonides, Hilchot melachim 8, 5ff.; Issure bia 13, 14ff.).
